Am I Eligible for Workers Compensation?

On the surface, workers’ compensation seems like a straightforward solution: if an employee is injured on the job, worker’s compensation will protect the business and the employee from potentially devastating injury costs. While this is exactly right, there are some grey areas surrounding worker’s compensation that you should be aware of.

Employer Must Carry Business Insurance

If you are injured on the job, you can only receive workers’ compensation benefits if your employer’s insurance policyincludes it as a feature. It is not legal for employers to forgo this coverage, so be sure you have a policy in place if you are a business owner.

Injury Must Be Work Related

In order to receive workers’ compensation, most policies require the injury to have taken place on company property and as a direct result of the working conditions.  Of course, illnesses or injuries that take time to develop like Asthma are included in this classification. Accidents that take place due to employee misconduct are not covered, however.

You Must Be a Payroll Employee

Workers’ compensation policies only cover the injuries of employees that are on a business’ payroll with a W4 form. Both full time and part time employees are covered under workers’ compensation. If a contractor is injured on a job, however, they will not be covered under workers’ compensation from the jobsite owner.

Statute of Limitations Must Be Met

If all of the conditions above are met, the only final requirement is that the injury is reported within in a reasonable amount of time. This is generally not an issue since most injured employees are quick to seek out monetary assistance if a valid workplace injury takes place. If an injury or illness develops over a long period of time, most policies will extend the reporting window.
